State Insurance Laws

Mississippi Auto Insurance - (MS)

Mississippi has financial responsibility laws that don’t necessarily require drivers to purchase a policy with liability coverage. As long as the driver can demonstrate that he/she is financially responsible, carrying an auto insurance policy is not legally necessary. However, drivers must spend an extraordinary amount of money and go to great pains to prove financial responsibility, so purchasing a policy remains the most popular way to comply with the law. Read on for additional information on Mississippi’s auto insurance regulations and what happens to drivers who violate them.

Auto Insurance Regulations in Mississippi

  • Mississippi requires all vehicles to be insured.
  • You must have proof of financial responsibility with you at all times. If you have a liability policy, you will need your insurance ID card in your vehicle at all times. If you instead proved financial responsibility to the motor vehicles department, you will need to carry the document that they gave you verifying it.
  • The minimum liability amounts are: $25,000 per person for injuries, $50,000 per accident for injuries, and $25,000 per accident for physical damage to another vehicle or someone else’s property.

Financial Responsibility

If you choose not to buy an auto insurance policy with liability coverage, the state of Mississippi will require you to provide proof of financial responsibility. Unless you have liability coverage that meets the state’s minimums, you will need to do one of the following:

  • Post a bond equal to the amount of the state’s auto liability minimums
  • Make a deposit of cash or securities equal to the liability minimums

Violations

Mississippi law does not allow a police office to pull you over just to verify that you have proof of insurance, but it does permit the officer to ask you for your insurance ID card during stops for other traffic violations. If you cannot provide proof of insurance, you will have to pay a fine of $1,000 for a first offense. Your driving privileges will also be suspended for a year or until you provide proof of insurance.
